Developing countries like Malawi are calculating the cost of adhering to new World Health Organization (WHO) guidelines that recommend starting HIV-positive people on antiretroviral drugs (ARVs) sooner. Malawi is one of three African countries that have conducted WHO-supported feasibility studies to assess what adopting the new guidelines would mean, and has announced plans to roll out the new WHO guidelines by mid-2011, said Dr Frank Chimbwandira, head of the HIV and AIDS department in the Ministry of Health.

Malawi's donors are disappointed and South African trade unionists prepare for protests.Not surprisingly, a court in Blantyre, Malawi's second city, yesterday convicted Steven Monjeza and Tiwonge Chimbalanga for committing so-called "unnatural offences" and "indecent practices between males". Mr Monjeza and Mr Chimbalanga were arrested in December 2009 after celebrating their engagement and have been in jail ever since.

The conviction and sentencing of two men in Malawi based on their sexual orientation presents a serious threat to the country’s AIDS response. Steven Monjeza and Tiwonge Chimbalanga were this week sentenced to 14 years in prison with hard labour for "indecent practices between males" and "unnatural offenses."

The Malawi Law Society (MLS), a constitutionally-recognised body that represents the interests of lawyers and the legal profession in Malawi, has called for the immediate release on bail of Malawi's incarcerated first openly gay couple, saying the society does not pose a danger to them and vice versa. In a statement published in the local media, MLS Secretary Jabber Alide was quoted as saying the two - like all accused persons in Malawi - should be presumed innocent until proved otherwise by the court of law.

Services to prevent the mother-to-child transmission (PMTCT) of HIV are gaining ground in Malawi but the country continues to battle drug shortages and mothers and infants that disappear to follow-up and treatment. In 2005 only three percent of HIV-positive mothers were using PMTCT services, and mother-to-child transmission of HIV accounted for 30 percent of all new infections nationally.

An engagement ceremony has landed a same-sex Malawian couple in jail, propelled their country into international headlines, and pushed men who have sex with men (MSM) further towards society's risky margins. Steven Monjeza and Tiwonge Chimbalanga were arrested and charged with sodomy and indecency after their public engagement in late December 2009.

African and British human rights campaigners rallied outside the Commonwealth’s head quarters in London on Monday 22 March.
